Conditions of Business for our Auctions

Please read these Terms and Conditions carefully. By using this website, you indicate your acceptance of these Terms and Conditions. If you do not accept these terms and conditions, please do not use this website.

Auctioneer Acting as Agent

• Lot 100 acts as agent for the seller of each individual lot

Acceptance of Bids

• All bids shall be treated as offers made upon the terms and conditions of sale. When you confirm your bid you are making a commitment to purchase – and it is legally binding.

• The highest approved bidder shall be the Purchaser. If a dispute arises as to a bid, the lot in dispute may be put up for sale again at the last undisputed bid and any dispute whatsoever in respect of the property or the sale and delivery of the goods shall be determined by the auctioneer.

• The bidding shall be regulated by the auctioneer and no bids shall be retracted.

• The auctioneer has the right to refuse any bid at his absolute discretion.

• The auctioneer retains the right to group together any lots, or to divide any lots during the sale, and in the case of lots upon which there is a reserve, the auctioneer has the right to bid on behalf of the vendor, or to withdraw a lot(s) from sale.

• The auctioneer accepts no liability for any failure or delay in placing bids or any errors contained in bids placed via the online sale platform. In using the online sale platform you agree that you are doing so at your own risk.

• The auctioneer accept no liability for delay, disruption or interruption of auction activity in the event of, but not limited to, technical problems, power cuts, electrical failure, fire, flooding and other acts of human error.

• The auctioneer reserves the right to modify the Date or Start Time of Beginning of Auction at its discretion

Viewing of Lots

• All lots are available to view in our office prior to Online auctions on designated times or by appointment.

The Buyer

• Every buyer on being declared as such by the auctioneer shall if required hand in his name and full address and if requested his bank or other suitable references.

• The purchase price payable by the buyer shall be the aggregate of the price at which the lot is knocked down and a premium of 25% of the final bid together with Value Added Tax on the premium at the prevailing rate. For example, on a hammer price of €1,000, the Buyer's Premium amounts to €250 and the VAT on the Buyer's Premium amounts to €57.50, giving a total amount due of €1307.50. The Buyers Premium may be subject to change.

Packing and Shipping

• Lot100 does not offer an in-house Shipping Service. The buyer shall be responsible for all packing and shipping costs for the purchased property. Where the Auctioneer, its employees or agents agrees to package Purchased Lots it is undertaken solely as a courtesy to buyers and is at the discretion of the Auctioneer. Under no circumstances shall the Auctioneer, its employees or agents be liable for damage of any kind and howsoever caused, theft, robbery or mishaps, delays, any duties or taxes due. Further, the Auctioneer shall not be liable for the errors or omissions of, or for any damage caused by, any packers or shippers which the Auctioneer has recommended.

Representations in Catalogue

• All statements in the catalogue or marketing and advertising are statements of opinion and are not to be relied upon as statements of fact. Descriptions or illustrations in the catalogue or advertisements are solely for guidance and are not to be relied upon for accuracy. Intending purchasers must satisfy themselves by inspection or otherwise as to the condition or authenticity of any lot. Furthermore, intending purchasers must satisfy themselves as to whether or not any lot has been repaired or restored.

• The auctioneers are not responsible for the correctness of any statement as to origin, date, age, attribution, genuineness or provenance of any lot.

• The auctioneers are not responsible for any defects in any lot.

• Condition reports will be available by request.

• It is the responsibility of the buyer to request any additional images in respect of defects to frames or the work of art, and to notice and accept these imperfections when placing a bid. There is no recourse from the auctioneer due to the transparent disclosure.

Non-Payment or Failure to Collect Purchased Lots

• If a buyer fails to pay for and/or collect any purchased Lot by the dates herein specified for payment and collection the Auctioneer shall, in its absolute discretion and without prejudice to any other rights or remedies it may have, be entitled to exercise one or more of the following rights or remedies without further notice to the buyer:

(a) To issue court proceedings for damages for breach of contract

(b) To rescind the sale of that Lot or any other Lots sold to the buyer whether at that or at any other auction

(c) To resell the Lot or cause it to be resold whether by public auction or private sale. In the event that there is a deficiency between the Total Amount Due by the buyer and the amount received by the Auctioneer on such resale after deduction of any necessary expenses the difference shall be paid to the Auctioneer by the buyer. Any surplus arising shall belong to the seller

(d) To store (whether at the Auctioneer’s premises or elsewhere) and insure the purchased Lot at the expense of the buyer

(e) To charge interest on the Total Amount Due at the rate of 2% per month over and above the base rate from time to time, or if there be no such rate, the nearest equivalent thereto as determined by the Auctioneer in its absolute discretion from the date on which payment is due hereunder to the date of actual payment

(f) To retain that Lot or any other Lot purchased by the buyer whether at the same or any other auction and release same to the buyer only after payment to the Auctioneer of the Total Amount Due

(g) To apply any sums which the Auctioneer received in respect of Lots being sold by the buyer towards settlement of the Total Amount Due

(h) To exercise a lien on any property of the buyer in the possession of the Auctioneer or whatever reason

• The auctioneers to be the sole judges in any dispute that may arise during the sale.

Buyer Information

All our online auctions have a closing date and time for each item. Please make yourself aware of this so you can bid in time and watch the auction as it proceeds.

Our auctions have an online catalogue, which is usually available about 10 days before each auction closes. Take time to search for the items you are interested in and to find new items of interest. Also make sure to satisfy yourself with the dimensions of the item and its condition. Our online catalogues can be found by selecting the upcoming auction on our home page. You will also find details on our Auctions page

As well as previewing items online, we also have live previews at our offices in Lismore, County Waterford. Details and times of these viewings are shown on the auction page. We encourage you to attend these viewings and to take the opportunity to ask any questions that you may have.

Buyers Costs & Charges Buyer’s premium and applicable taxes are added to the hammer (final) price.

The buyer shall pay the Auctioneer a commission (Buyers Premium) at the rate of 25% on the hammer price, plus VAT of 23% (applied only to the commission) on all individual lots.

For example on a hammer price of €1,000, the Buyer's Premium amounts to €250 and the VAT on the Buyer's Premium amounts to €57.50, giving a total amount due of €1307.50.

Registration You are required to register for all of our auctions.

Bidding

Place online bids anytime up to the end time for the desired lot. If a bid is received in the final two minutes of the auction, the countdown clock is reset for an additional two minutes of bidding until no further bids are received.

You can leave absentee bids by entering the maximum amount you would like to bid up to and the software will bid on your behalf only as much as required for you to remain the highest bidder up until your maximum bid. *Please Note - should you have placed a maximum bid beyond the Reserve - but bidding ends below the Reserve, the software will bring you up to the Reserve in order to secure the Lot.

Bidding Increments are as follows:

• €50 - €199 by €5

• €200 - €499 by €10

• €500 - €999 by €20

• €1,000 - €1,999 by €50

• €2,000 - €4,999 by €100

• €5,000 - €9,999 by €200

• €10,000 and over by €500

After the Auction

Auction Payment

You will receive an invoice via email after the auction. Payment can be made using our Online Payment Option or by Bank Transfer or Bank Draft. Payment for purchases must be made within 48 hours of the auction.

Shipping, Collections and Storage

Lot100 do not offer an in-house shipping service. We are pleased to recommend the following for deliveries of art, nationally and internationally. You may wish to contact them in advance of bidding to obtain a quote. Lot100 accepts no responsibility for any loss or damage that may occur in transit or as a result of us recommending any shipping / delivery company.

Items must be paid and collected / shipped within 7 days after the sale. Any item that has not been collected or not arranged for shipping shall be liable to a storage charge thereafter of 1% of the hammer price (or a minimum of €15.00) per item per week.

Collect from our Office

Items may be collected from our office at The Old Library, Chapel Street, Lismore, County Waterford P51 ET99 by prior arrangement and during office hours at no cost. Please contact us at 0861712813 or info@lot100.ie in advance of collecting in order for your item(s) to be ready for you to collect.

Dublin Collections / Pick Ups

Items may be collected at Hamilton House, 28 Fitzwilliam Place, Dublin D02 P283 by prior arrangement and during specific hours at no cost. Please contact us at 0861712813 or info@lot100.ie in advance of collecting, in order for your item(s) to be ready for you to collect.

Protecting Auctioneers

To ensure the protection of all parties we work with from any form of illegal, unfair, or inappropriate behaviour, we take practical measures. This involves keeping track of account activities, including user contact information, device usage, website activity, bidding history, purchase records, and payment history. This information is shared with other relevant partners, such as auctioneers, to assist parties in managing their commercial risks in the context of our joint services.

In the event that behaviour is deemed inappropriate or presents a threat, we reserve the right to temporarily halt automatic approvals. In such cases, you will need to directly communicate with the auctioneer in order to participate in their auction.

White Label Platforms

When we offer technological services to an auctioneer, you become a direct customer of the auctioneer and they assume the role of data controller. The auctioneer is accountable for the handling of your data. Any enquiries or concerns regarding your data should be directed to the auctioneer.
